Terms of Service

These terms are an agreement between you and 3SumGames ("we", "us"). They apply to every mobile game we publish and to the website 3sumgames.com (together, the "Services"). By downloading, installing or playing our games, you agree to these terms.

1. Who can use our games

You must be at least 13 years old, or the minimum age required in your country, to use our games. If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf and is responsible for any purchases you make.

2. Your license to play

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and play our games on devices you own or control, for your own non-commercial entertainment. You may not:

• Copy, modify, distribute, sell, rent or sublicense our games or any part of them.
• Reverse engineer, decompile or try to extract the source code, except where the law allows it.
• Remove or change any copyright, trademark or other notices.
• Use our games for any commercial purpose without our written permission.

3. Rules of play

When you use our Services, you agree not to:

• Cheat, or use bots, hacks, mods or any unauthorized software that changes the game.
• Exploit bugs or glitches for an advantage. Please report them to us instead.
• Interfere with, disrupt, or try to gain unauthorized access to our games, servers or networks.
• Get virtual items or currency by fraud, chargebacks or unauthorized purchases.
• Interfere with how ads are displayed, or generate fake ad impressions or clicks.
• Break any law while using our Services.

4. In-app purchases and virtual items

• Payments: in-app purchases are processed by Google Play and are also subject to the Google Play Terms of Service. Prices are shown in the game before you confirm a purchase.
• Virtual items: virtual currency, items and other content (together, "Virtual Items") are licensed to you, not sold. They have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred or sold outside the game.
• Consumable items: items that are used up during play, such as coins or extra lives, cannot be restored once used.
• Refunds: refund requests are handled by Google Play under Google Play's refund policies. Unless required by law, we do not offer refunds directly. Nothing in these terms limits refund rights you have under consumer law.
• Lost purchases: if a purchase is not delivered, email us with the Google Play order number and we will help restore it.
• Changes to Virtual Items: we may change, rebalance or remove Virtual Items as part of updating the game. If a game is discontinued, we will give reasonable notice where possible.

5. Advertising

Our games may show ads from Google AdMob and its partners, which help keep our games free. We are not responsible for the content of third-party ads, or for any products, services or websites they link to. How ad partners use data is explained in our Privacy Policy.

6. Google Play and third parties

Our games are distributed through Google Play. Your use of Google Play is governed by Google's own terms. Google is not responsible for our games or for support related to them. Our games may also contain links to or features from third-party services, which have their own terms and policies.

7. Our intellectual property

3SumGames, or our licensors, own all rights to our games and website, including code, artwork, characters, music, sounds, names, logos and trademarks. These terms do not give you any ownership rights in them.

8. Feedback

If you send us ideas, suggestions or feedback, you agree that we may use them freely to improve our games, without any obligation to pay you.

9. Updates and availability

We may update our games to fix bugs, add features or meet legal requirements. Some updates may be required to keep playing. We may also change, suspend or discontinue a game or feature at any time. We do not promise that our games will always be available or free of errors.

10. Termination

You can stop using our games at any time by uninstalling them. We may suspend or end your access to our Services if you break these terms, or where required by law. Sections that by their nature should continue after termination, such as intellectual property, disclaimers and limitation of liability, will continue to apply.

11. Disclaimers

To the extent permitted by law, our Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some countries do not allow these exclusions, so they may not all apply to you.

12. Limitation of liability

To the extent permitted by law, 3SumGames will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of our Services. Our total liability for any claim will not exceed the amount you paid us for in-app purchases in the 12 months before the claim, or USD 50, whichever is greater.

Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

13. Indemnity

To the extent permitted by law, you agree to compensate 3SumGames for any claims, losses or expenses, including reasonable legal fees, that arise from your breach of these terms or your misuse of our Services.

14. Governing law and disputes

These terms are governed by the laws of Bangladesh, without regard to conflict of law rules. Before starting any formal dispute, please contact us so we can try to resolve the issue informally. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and may bring claims in your local courts.

15. General

• These terms, together with our Privacy Policy, are the entire agreement between you and us about our Services.
• If any part of these terms is found unenforceable, the rest remains in effect.
• If we do not enforce a right, that does not mean we have waived it.
• You may not transfer your rights under these terms. We may transfer ours, for example as part of a merger or sale.

16. Changes to these terms

We may update these terms from time to time. When we do, we will change the "Last updated" date at the top. If a change is significant, we will tell players in the affected games before it takes effect. If you keep playing after the change, you accept the updated terms.
